Seacoast Preservation Association is a broad-based coalition of concerned and caring Encinitas bluff-top homeowners who share a commitment to protecting their property rights and home values.
About:
All bluff-top property homeowners have development options that are allowable by right and consistent with the Encinitas Municipal Code and Local Coastal Program (LCP).
Our group is a resource for homeowners who need information on property rights or are navigating the entitlement & permit process with the City of Encinitas & California Coastal Commission (CCC).
Our network of local professionals will assist Seacoast Preservation Association members in protecting the right to develop and preserve their property when interfacing with the City of Encinitas & CCC Staff.
The Association monitors public affairs, policies and forums on the state and local level, sharing updates on legislation and political activity that could potentially impact bluff-top property rights as an owner.
The Challenge:
Climate change and its impact, along with erosion, are shrinking and threatening our cliffs and bluffs. Coast bluff failures from Grandview Beach to Del Mar occur periodically and suddenly, and from a variety of forces severely impacting bluff-top properties.
The prevalent ideology of the CCC is “planned retreat,” anti-seawall, and anti-property protection measures; whereas, bluff-top homeowners want to maintain the right to develop, preserve, and protect their top of bluff properties.
Negotiations are underway to develop a comprehensive coastal bluff policy towards coastal bluff-top development. However, as it relates to top of bluff development and bluff setback in today’s environment, the CCC’s interpretation of the Coastal Act is more conservative than ever before. In addition, where once the City of Encinitas supported exemptions, City Staff has adopted the CCC’s conservative approach to bluff-top development.
This conservative position and lack of consistency creates a challenging process for bluff-top property owners. Many homeowners have little knowledge and understanding of the Coastal Act and the roles of the CCC, and the City of Encinitas. As a result, residents incur severe financial costs and profoundly frustrating delays when navigating the permit and entitlement process and defending their property rights.
The Solution:
We need to organize and develop strength and unity within our community to affect change at the state and local level. The Seacoast Preservation Association believes it is time for Encinitas bluff-top homeowners to unite and have a voice to influence and promote clear, concise coastal regulations to protect our property rights.
